With the coming into force of the new Bill 76, construction quality and safety are more than ever a priority in Quebec. Construction supervision - Law 76:

Act no. 76, entitled "An Act to improve construction quality and public safety", was assented to in Quebec on November 27, 2024.

This legislation introduces several significant changes to the Building Act, including:

Extended scope: The law now applies to installations of systems designed to produce or store energy, including renewable energy.

New obligations for contractors and owner-builders :

Monitoring plan: Obligation to draw up a site monitoring plan, including inspections at at least three key stages of construction.

Certificate of compliance: Upon completion of the work, a certificate confirming compliance with the Construction Code must be obtained.

Contract with a professional: Before work begins, you must sign a contract with an engineer, architect or person recognized by the Régie du bâtiment du Québec (RBQ) to supervise inspections and issue the certificate of compliance.

Administrative financial penalties: The law introduces financial penalties for breaches of the new obligations, with fines ranging from 500 $ to 5,000 $ for individuals and from 1,500 $ to 10,000 $ for legal entities.

Some of the law's provisions came into force on November 27, 2024, while others will take effect after the RBQ adopts regulations, expected within 18 months.

These measures are designed to improve the quality of construction in Quebec and enhance public safety by imposing stricter standards on industry professionals.
